Terms of Service.

NextGen Skills Studio — the terms that apply when you enroll in a workshop or use this Website.

1. Introduction

These Terms of Service (“Terms”) govern your access to and use of this Website (the “Website”), our social media pages, our WhatsApp communication channels, and all workshops, courses, mentorship sessions, webinars, materials and related services (together, the “Services”) provided by NextGen Skills Studio (“NextGen”, “we”, “us” or “our”).

NextGen Skills Studio is operated by NextGen, based in Lahore, Pakistan.

By accessing the Website, contacting us, enrolling in any workshop, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

These Terms should be read together with our Privacy Policy and our Refund Policy, which form part of these Terms.

2. Definitions

In these Terms:

“Student” or “you” means any person who enrols in, attends, or uses any of the Services, or who accesses the Website.

“Workshop” means any paid live training programme, course, cohort or short course offered by NextGen, whether conducted online or in person.

“Mentorship” means any one-to-one or small-group guidance session provided by a NextGen mentor or instructor.

“Course Materials” means all content provided as part of the Services, including but not limited to slides, recordings, videos, documents, templates, worksheets, prompts, checklists, assignments and any other resources, in any format.

“Fee” means the amount payable for a Workshop, Mentorship or other paid Service.

“Instructor” or “Mentor” means any person delivering Services on behalf of NextGen.

3. Eligibility

You must be at least 18 years old to enroll in a paid Workshop in your own name.

Students aged between 13 and 28 may enroll only with the consent of a parent or legal guardian, who must agree to these Terms on the student’s behalf and who is responsible for the student’s compliance with them.

By enrolling, you confirm that the information you provide to us is true, accurate and complete, and that you will keep it up to date.

We reserve the right to refuse enrolment to any person at our discretion, without being required to give a reason.

4. Our Services

NextGen provides practical training in digital skills, which may include graphic design, social media marketing, video editing, AI tools, automation, performance marketing, freelancing, client acquisition, AI-assisted research and other related subjects.

Workshops are primarily delivered live and online using third-party platforms such as Zoom and Google Meet. Some Services may be delivered in person at a location we specify in advance.

The content, structure, schedule, duration and instructors of any Workshop may vary between batches. We continually update our curriculum to reflect changes in tools, platforms and market demand.

We may add, change, suspend or discontinue any part of the Services at any time. Where a change materially affects a Workshop you have already paid for, we will notify you and, where appropriate, offer an alternative date, an alternative Workshop, or a remedy under our Refund Policy.

5. Enrolment and Accounts

Enrolment is completed by contacting us through WhatsApp or another channel we designate, selecting a Workshop, and paying the applicable Fee.

Your place in a Workshop is confirmed only once we have received full payment, or the first instalment where an instalment plan has been agreed, and have sent you written confirmation.

Seats in each Workshop are limited. Places are allocated on a first-come, first-served basis once payment is confirmed.

Enrolment is personal to you. You may not transfer your place, share your access, or allow any other person to attend a session in your place without our prior written consent.

Where we provide access links, group chats, login details or other access credentials, you are responsible for keeping them confidential. You must not share them with anyone else. If we find that access has been shared, we may revoke your access without refund.

6. Fees and Payment

Fees are stated in Pakistani Rupees (PKR) unless we state otherwise. Students outside Pakistan may be quoted in another currency.

Payment may be made by bank transfer, JazzCash, Easypaisa, or other methods we specify. You are responsible for any bank charges, transfer fees or currency conversion costs.

Where we offer an instalment plan, all instalments must be paid by the agreed dates. If an instalment is not paid on time, we may suspend your access to the Workshop and Course Materials until payment is received.

We may change our Fees at any time. Changes will not affect any Fee you have already paid.

Promotional prices, discounts and offers are valid only for the period and conditions stated, cannot be combined unless we say so, and may be withdrawn at any time.

You must retain proof of payment, such as a transaction ID or screenshot, and provide it to us on request.

7. Refunds

Refunds are governed by our Refund Policy, which is available on request and forms part of these Terms.

In summary, if you attend the Workshop in full, complete all assigned tasks, follow the guidance provided by your instructors and mentors, and still do not see results, you may request a refund within 3 days of the end of your Workshop, subject to the conditions set out in the Refund Policy.

Where these Terms and the Refund Policy conflict on any matter relating to refunds, the Refund Policy prevails.

8. Attendance, Scheduling and Recordings

You are responsible for attending scheduled sessions on time and ensuring you have a working device and a stable internet connection.

We are not responsible for sessions you miss because of your own internet, device, power or scheduling problems.

Where recordings are provided, they are made available for your personal review only, for a limited period of time, and may be removed after that period.

We may reschedule a session due to instructor illness, technical failure, public holidays, load-shedding, emergencies or other circumstances beyond our reasonable control. We will give as much notice as reasonably possible and provide a replacement session or a recording.

Sessions may be recorded for quality, training and record-keeping purposes. By attending, you consent to being recorded. If you do not wish your camera image or voice to appear in a recording, you may keep your camera and microphone off except when asked to participate.

9. Student Conduct

You agree to behave respectfully towards instructors, mentors, staff and other students at all times, both during sessions and in any group chats or community spaces.

You must not:

  • harass, abuse, threaten, insult or discriminate against any person;
  • share offensive, sexual, violent, hateful or illegal content;
  • disrupt sessions or interfere with other students' learning;
  • promote your own or any third party's products, services, courses or groups without our permission;
  • contact other students for commercial purposes or solicit them to join competing programmes;
  • record, photograph, screenshot or distribute sessions or Course Materials except as permitted in these Terms;
  • impersonate any person or misrepresent your identity;
  • use the skills or tools taught to engage in fraud, spam, scams, hacking, plagiarism, academic misconduct or any unlawful activity.

If you breach this section, we may issue a warning, remove you from sessions or group chats, or permanently terminate your enrolment without refund, depending on the seriousness of the breach.

10. Intellectual Property

All Course Materials, the Website, our branding, logos, trade names, designs, graphics, text and content are owned by or licensed to NextGen and are protected by intellectual property laws.

Upon full payment, we grant you a limited, personal, non-exclusive, non-transferable and revocable licence to access and use the Course Materials solely for your own personal learning.

You must not, without our prior written consent:

  • copy, reproduce, resell, redistribute, publish or share any Course Materials, in whole or in part;
  • upload Course Materials to any website, social media platform, cloud storage folder or group chat accessible to others;
  • use Course Materials to create, teach or sell your own course, workshop or training programme;
  • remove any copyright notices or branding from Course Materials.

Work that you create yourself during a Workshop, such as designs, videos, campaigns or portfolio pieces, belongs to you. However, where your work incorporates templates, assets or materials provided by us, those underlying materials remain our property.

You grant us permission to display work you create during a Workshop, with credit to you, for promotional purposes, unless you tell us in writing that you do not wish it to be used.

11. Testimonials and Feedback

If you provide us with a review, testimonial, message, screenshot or other feedback, you grant us permission to publish it on our Website, social media and marketing materials, together with the name and details you have agreed to share.

We will not publish your testimonial without your consent, and we will not alter its meaning. We may correct spelling, grammar or length for readability.

You may withdraw your consent at any time by contacting us, and we will remove the testimonial from our Website and future materials within a reasonable period.

12. No Guarantee of Income or Results

Our Services are educational. We teach skills, provide guidance and share methods that we and our instructors use in practice.

We do not guarantee that you will earn any particular amount of money, secure any particular number of clients, obtain employment, or achieve any specific outcome. Your results depend on many factors outside our control, including your effort, consistency, prior experience, available time, market conditions and the decisions of third parties such as clients and platforms.

Any figures, earnings examples, case studies or student stories shared by us are illustrative of what is possible and are not a promise or prediction of your results.

Nothing in this section limits any rights you have under our Refund Policy.

13. Third-Party Platforms and Tools

Our Services may involve the use of third-party platforms and tools, including but not limited to Zoom, Google Meet, WhatsApp, Canva, Meta Business Suite, Fiverr, Upwork, LinkedIn, and various AI tools.

These platforms are owned and operated by independent companies. Your use of them is governed by their own terms and policies, and you are responsible for complying with them.

We are not responsible for any changes, outages, account suspensions, fees, policy decisions or actions taken by third-party platforms, including any decision by a freelancing platform or social network to restrict or close your account.

Some tools may require paid subscriptions. Unless we state otherwise, the cost of any third-party tool or subscription is your responsibility.

We are not affiliated with, endorsed by, or sponsored by any third-party platform named in our Services unless we expressly state otherwise.

14. Responsible Use of AI and Academic Integrity

Where we teach the use of AI tools, including for research, writing or content creation, we teach them as aids to your own work.

You are responsible for complying with the rules of any university, journal, employer, client or platform regarding the use of AI, including disclosure requirements.

You must not use what you learn to submit AI-generated work as your own where this is prohibited, to plagiarise, to fabricate data or sources, or to engage in any form of academic or professional misconduct. We accept no responsibility for any consequences arising from such misuse.

15. Website Use

You may use the Website for lawful purposes only.

You must not attempt to gain unauthorised access to the Website, interfere with its operation, introduce viruses or malicious code, scrape its content by automated means, or use it in any way that could damage our reputation or systems.

The Website may contain links to third-party websites. These are provided for convenience only. We do not control and are not responsible for their content, availability or practices.

We aim to keep the Website accurate and available, but we do not warrant that it will be uninterrupted, error-free or free from harmful components.

16. Privacy

We collect and use your personal information in accordance with our Privacy Policy.

By using the Services, you consent to our processing of your information as described in the Privacy Policy, including contacting you through WhatsApp, phone or email about your enrolment and our Services.

17. Limitation of Liability

To the fullest extent permitted by law, NextGen, its founders, instructors, mentors and staff shall not be liable for any indirect, incidental, special or consequential loss, including loss of income, loss of clients, loss of business opportunity, loss of data, or damage to reputation, arising from or in connection with the Services.

Our total liability to you for any claim arising from or relating to the Services shall not exceed the total Fees you paid to us for the specific Workshop or Service giving rise to the claim.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under the laws of Pakistan.

18. Indemnity

You agree to indemnify and hold harmless NextGen, its founders, instructors and staff from any claims, losses, damages or expenses, including reasonable legal fees, arising from your breach of these Terms, your misuse of the Services or Course Materials, or your violation of any law or the rights of any third party.

19. Suspension and Termination

We may suspend or terminate your access to the Services immediately if you breach these Terms, fail to pay any Fee when due, or act in a way that we reasonably believe harms other students, our staff or our reputation.

Termination for breach does not entitle you to a refund.

You may stop using the Services at any time. Any refund is subject to our Refund Policy.

Sections relating to intellectual property, testimonials, limitation of liability, indemnity and governing law continue to apply after your enrolment ends.

20. Events Beyond Our Control

We are not liable for any delay or failure to provide the Services caused by events beyond our reasonable control, including internet or power outages, load-shedding, natural disasters, public emergencies, government action, platform outages, illness of instructors, strikes or civil unrest. In such cases we will make reasonable efforts to reschedule or provide an alternative.

21. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on the Website with a new “Last updated” date.

Changes will not apply retrospectively to a Workshop you have already paid for, unless the change is required by law.

Your continued use of the Services after changes are posted means you accept the updated Terms.

22. Governing Law and Disputes

These Terms are governed by the laws of the Islamic Republic of Pakistan.

If a dispute arises, you agree to contact us first so that we can try to resolve it informally. Most concerns can be settled quickly through a direct conversation.

If a dispute cannot be resolved informally within 30 days, it shall be subject to the exclusive jurisdiction of the courts of Lahore, Pakistan.

23. General

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force.

Our failure to enforce any right or provision does not constitute a waiver of that right.

You may not transfer your rights or obligations under these Terms. We may transfer ours to a successor or affiliated entity.

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and us regarding the Services.
